Wrongful Death Claims

When a loved one dies as a result of a car accident, a workplace accident, a medical error, or some other act of negligence, a wrongful death claim can be filed on behalf of certain members of the family. A wrongful death claim is governed by the provisions of §895.04 of the Wisconsin Statutes. Pursuant to this statute, only certain members of the family can pursue a claim, depending upon the identity of the deceased:

  • If the deceased was married, the claim would rest with the estate of the deceased and the deceased’s surviving spouse.
  • If the deceased was unmarried, the claim would rest with the estate of the deceased and the deceased’s children, parents or brothers/sisters, if the brother/sisters were under the age of 18 at the time of death.
  • In cases of medical errors, there can be no recovery for the loss of a society and companionship of a loved one if the deceased was an adult and is not survived by a spouse or minor children.

When a person dies as a result of the negligent conduct of another, there are several claims that can be made by the estate and the surviving family members. They include:

  • Conscious pain and suffering of the deceased
  • Medical, funeral and burial expenses
  • Lost financial support of the deceased
  • Loss of society and companionship of the deceased, the recovery of which is capped for all claimants at $350,000 for the death of an adult and $500,000 for a minor.
