Wisconsin Appeals Court Upholds $8 Million Settlement

The settlement awarded to a woman whose internal organs were left paralyzed after a botched surgery has been upheld by a Wisconsin Appeals Court.

This $8 million settlement is significant because it is the first major case after the State Supreme Court struck down a Wisconsin law that placed a cap on the amount that could be awarded in medical malpractice suits.

The medical malpractice fund held that the settlement should not be upheld as the judge apparently coerced the jury when they were deadlocked into reaching a decision in the woman’s favor. The Appeals Court held that that was not grounds for mistrial and upheld the settlement.
