Birth injury case awards $23.3 million

A jury sided with a case brought against a Milwaukee-area doctor that awarded a family $23.3 million.

According to the family of the suit, the doctor failed to perform a Cesarean section operation when a mother found herself in a lengthy labor in 2005. Instead, the doctor opted to have a medical resident deliver the child using forceps. As a result, the mother argued, her son suffered brain damage. The boy, now five years old, lives with cerebral palsy. He is not expected to ever be capable of living alone or holding a job.

The settlement is intended to cover medical expenses both in the past and in the future, loss of income, and pain and suffering. The suit was pressed against both the doctor at St. Joseph Regional Medical Center and the Injury Patients and Families Compensation Fund.

Following the verdict, the doctor’s attorney said that an appeal should be expected to be filed in the near future.
