$1.5M Verdict in Kankakee Co. Medical Malpractice Lawsuit

A jury in Kankakee County, Illinois last week returned a $1.5 million verdict against a hospital and emergency room doctor following the wrongful death of a woman in 2006.

According to Michael Cogan, the prosecuting attorney, Dr. Timothy Moran misdiagnosed 20 year-old Michelle L. Koenig in 2006 while working at Provena St. Mary’s Hospital. Moran was working at the hospital through an outside staffing firm. The lawsuit claimed Moran misdiagnosed chicken pox as a rash and discharged Koenig on February 19, 2006.

Koenig died two days later after the virus spread to her liver.

The lawsuit went to trial before Kankakee County Circuit Court Judge Kendall O. Wenzelman. Cogan said the Koenig family tried “aggresively” to reach a settlement with the hospital, but the facility would not offer more than $18,000. The trial lasted two weeks, before the jury found in favor of the family. “Closure is what they were really looking for,” Cogan said of the family. “Now they have it.”
