Types of damages you can recover in a medical malpractice claim

Through a medical malpractice claim, a reckless doctor, dental staff, or nursing aide that caused you undue harm or injury could be held accountable for all the damages that you have incurred. Because the state and the federal laws allow medical malpractice victims to be compensated for the damages they have suffered, it is important for the suing party to understand what they can recover.

In medical malpractice cases, plaintiffs can usually recover three types of damages:

  1. General damages – Damages of this type are usually non-quantifiable. Mental and physical pain, loss of enjoyment of life, and loss of capacity to earn in the future are among the damages that, although real, could be more difficult to put a price tag on
  2. Special damages – Special damages refer to those that are easier to quantify, such as medical bills, future medical expenses, and days off work
  3. Punitive damages – Also called exemplary damages, punitive damages are done to teach the defendant and others a lesson
