A state audit revealed that the $1.2 billion “Injured Patients and Families Compensation Fund” has an excess of $783 million. The surplus, according to a group of trial lawyers, shows how difficult it is for medical malpractice victims to win a claim against negligent medical professionals.

The state-run trust fund is used to award malpractice claims of over $1 million. However, claim restrictions and compensation limitations can make it difficult for Wisconsin malpractice victims to secure compensation, attorneys stated. In Wisconsin, parents are prohibited from filing a medical malpractice claim on behalf of their adult children and vice versa.
