Unpaid Overtime for IT Help Desk and Quality Assurance Employees

Help desk employees, computer support specialists, and similar job positions are on the rise as more and more workplaces become dependent upon computers. Many employers consider any employee who works with computers to be an exempt “computer professional” and fail to pay those employees overtime wages for hours worked over 40 in a work week.

But just being paid a salary is not enough. To be exempt from overtime, a computer employee must:

  • Be employed as a computer systems analyst, computer programmer, software engineer, or other similarly skilled worker; AND
  • Have job duties that require a high level of skill applying specialized knowledge.

Courts have generally found that individuals who work with computers but whose work is routine, or does not require a high degree of skill, must be paid overtime wages (regardless of whether they are paid a salary or an hourly wage.)
