Personal Injury Lawyer in Madison, Wisconsin
David S. Blinka is a shareholder at Habush Habush & Rottier and has practiced in the firm’s Madison office since 2012.
Immediately prior to joining Habush, he pursued his passion for trial practice by volunteering at the Milwaukee County District Attorney’s Office where he was fortunate to gain experience in criminal law by serving his community.
David then transitioned to civil practice at the Habush firm by assisting the firm in its representation of more than 200 Wisconsin property owners following a gasoline pipeline spill in the Town of Jackson, which contaminated the groundwater and private wells. The matter ultimately resulted in a successful settlement for all of the property owners. This experience helped establish a foundation for David’s work handling complex personal injury and civil litigation matters.
Today, David represents individuals and families primarily for claims involving motor vehicle accidents, premises injuries, and wrongful death. He has obtained numerous significant settlements and verdicts for his clients, including a recent $1.47 million jury verdict in an automobile accident case.
David’s success in trial practice has also extended to success on behalf of clients in Wisconsin’s appellate courts. In Bolger v. Massachusetts Bay, 2024 WI App 19, he successfully challenged an insurer’s denial of coverage for significant injuries sustained by his client arising from another’s negligent operation of a utility terrain vehicle. He successfully secured coverage for his client’s injuries.
In Stelling v. Middlesex, 2023 WI App 10, David argued before the Wisconsin Court of Appeals in a case involving the interpretation of Wisconsin’s venue selection statutes. The court’s decision clarified the application of these statutory provisions and protected his client’s right to choose the rightful location for that case.
By devoting his career to helping those who suffer from the wrongful acts of others, he has earned distinction from various institutions. David has been recognized by Best Lawyers in America® since 2027 and has been recognized as a Super Lawyer® since 2023, following recognition as a Rising Star from 2014–2022. He has also been recognized by the Wisconsin Pro Bono Honor Society for providing volunteer legal representation to individuals in need of access to justice.
Outside of his practice, David is active in the legal community. He serves as Treasurer of the Dane County Bar Association and is a member of the Wisconsin State Bar and the Wisconsin Association for Justice. He has published articles and presented at continuing legal education seminars on litigation and insurance-related topics. He also serves on the board of the Wisconsin Association for Justice.
Beyond serving the legal community, David also volunteers his time as the Vice President on the board of directors for the Woodland Montessori School in Madison, Wisconsin.

Client Testimonials
My Attorney, David S. Blinka, went the extra mile for me. I was in a car accident and he took care of dealing with the lawsuit against the insurance company so that I did not have to worry and could concentrate on healing from my injuries. He also took the time to explain everything to me in a way I could understand. Being a single mom with my hands already full, made my life easier knowing I did not have to worry about the legal part of the accident. I highly recommended this Law Firm.

Working with Dave made it such a painless and simple process. He and his colleagues did all the work and I was absolutely amazed at what he got me for a settlement. Plus I’m not the easiest client, sometimes impossible to get a hold of, but he never got mad or impatient, God knows I would have. He is an excellent attorney I hope to never have to hire again, but he would be the 1st name I’d recommend to family and friends.

I can’t say enough positives about how David handled my case. He was easily reachable at all times, he answered all my questions and explained things in an easy way to understand also. He fought for what we both agreed was fair. He’s very knowledgeable about accident cases and guided me very effectively throughout the entire process from beginning to end. I would recommend and refer anyone who needs representation to David, 100%. Thanks.

After an MVA in 2016, resulting in injury, I decided to seek legal counsel after being left with chronic pain. Having never sought legal representation for this sort of thing, I was a bit anxious about what to expect. David (and his assistant Kathy) were very patient with me and explained everything every step of the way. I felt pretty relaxed with the whole process when it could have been overall very nerve-wracking. I never felt rushed with our conversations and felt reassured along the way that I did have a case that could be settled in my favor. Most of all, I felt like I was treated like a human being, not a paycheck. Thank you, I appreciate all of your hard work for me!
